Review of Text Amendment Application TXT2004-00210 – revising and clarifying the sign regulations of the Zoning Ordinance. 

II. PUBLIC HEARING

A. Variance Application APP2004-00825, Reginald Miller – a variance to construct a sunroom in rear yard at 1107 Halesworth Drive.

B. Variance Application APP2004-00826, Saul Kravitz – a variance to construct a covered porch at 1386 Stratton Drive.

C. Variance Application APP2004-00827, Joseph Dulany – a variance to construct an addition at 819 Aster Boulevard.

D. De Minimis Revision for Variance Application APP2003-00801 – for a roof line change for a front porch on a previously approved variance.

E. Variance Application APP2003-00814, Stephen Beck - The applicant has applied for a two-foot variance from the front yard setback requirement as well as a 7.5-foot variance from the right side yard requirement to construct a front porch and a rear addition at 12 South Adams Street.

F. Special Exception Application SPX2004-00340, Orteck International – The applicant has applied for a special exception to establish and operate a business engaged in the retail sale and installation of vehicle tires, batteries, stereo installation, custom window tinting, and accessory sales, including service incidental thereto at 706 Rockville Pike.

The following applications were filed, tentatively, for July 10, 2004:

  1. Special Exception Application SPX2004-00342, Rockville Blades LLC, 50 Southlawn Court – to establish and operate food concessions area as a full service restaurant located on the first floor of the ice rink and modify a portion of the upstairs mezzanine area for added restaurant/sports bar use.

  2. Special Exception Application SPX2004-00341, Rockville Blades LLC, 50 Southlawn Court – request to sell beer and wine by proposed restaurant located on the ice rink on the second level mezzanine lounge area of the facility. 

  3. Variance Application APP2004-00828, Montgomery County, 1283 Seven Locks Road – for a variance from the side yard setback requirement and height variance for a vehicle storage facility.

  4. Variance Application APP2004-00829, John A. Hansman, 6 Radburn Court – for a variance to convert a carport storage area to dining room.

  5. Preliminary Development Plan PDP1994-0001E, Tower 3 Associates Inc – an amendment to PDP1994-0001D to redevelop Parcel 2-J from its previously approved land use of office and retail to a mixed use development of primarily residential with street level commercial, residential amenity facilities and structured parking.  The new project is referred to as “The Fitzgerald”. 

  6. Special Exception Application SPX2004-00344, Board of Education, 2100 Wootton Parkway – for two portable classrooms.

  7. Special Exception Application SPX2004-00345, Board of Education, 5911 Ridgway Avenue – to Install one portable classroom.

NOTICE: The Thursday evening following each regular Saturday Board of Appeals meeting is reserved for continued meetings.  The Board's policy is to end regular meetings no later than 4:00 p.m.  Agenda items unable to be heard by that time wioll be rescheduled to the afore noted hearing date.

Maryland law and the Board of Appeals' Rules of Procedure regarding ex parte (extra-record) communication require all discussion, review, and consideration of this matter take place only during the Board's consideration of the item at a scheduled meeting. Telephone calls and meetings with Board members in advance of the meeting are not permitted. Written communication will be directed to appropriate staff members for response and included in briefing materials for all members of the Board.
