I. PUBLIC HEARING

A. Variance Application APP2004-00825, 1107 Halesworth Drive
This variance application was deferred at the Board of Appeals’ June 5, 2004 Meeting in order for the applicant to submit better elevations for the proposed sunroom.

B. Variance Application APP2004-00828, Michael Lowe, Montgomery County Department of Public Works and Transportation – to construct a vehicle storage building for 50 vehicles and related equipment on the site at 1283 Seven Locks Road.

C. Special Exception Applications SPX2004-00341 & SPX2004-00342, Lewis Warsaw/ Rockville Blades LLC – for two special exceptions to sell beer and wine by the proposed restaurant located in the ice rink on the second level of the mezzanine lounge area of the facility.  A second request to formerly establish and operate the food concessions area as a full service restaurant located on the first floor of the ice rink and modify a portion of the upstairs mezzanine area for added restaurant/sports bar use.  The property is located at 50 Southlawn Court.

The following applications were filed, tentatively, for September 11, 2004:

  1. Special Exception Application SPX2004-00343, Rockville Associates Inc.
    Request to establish and operate an automobile sales business (outdoor and indoor motor vehicle sales) in the RPC Zone at 1570 Rockville Pike.

  2. Special Exception Application SPX2004-00343, TA Western
    Request to expand the floor/office space of the existing credit union at 15245 Shady Grove Road

NOTICE: The Thursday evening following each regular Saturday Board of Appeals meeting is reserved for continued meetings.  The Board's policy is to end regular meetings no later than 4:00 p.m.  Agenda items unable to be heard by that time wioll be rescheduled to the afore noted hearing date.

Maryland law and the Board of Appeals' Rules of Procedure regarding ex parte (extra-record) communication require all discussion, review, and consideration of this matter take place only during the Board's consideration of the item at a scheduled meeting. Telephone calls and meetings with Board members in advance of the meeting are not permitted. Written communication will be directed to appropriate staff members for response and included in briefing materials for all members of the Board.
