The City of Rockville Board of Appeals convened in regular session in the Mayor and Council Chamber at 9:30 a.m., March 10, 2007.

PUBLIC HEARING

Variance Application APP2006-00872, Matthew Shapiro  – At the Board of Appeals’ February 3, 2007 meeting, Variance Application APP2006-00872 was continued to give the applicant the opportunity to provide revised drawings of the location and dimensions of the chimney and air conditioning unit and a rendering of those improvements along with a revised roofline of the carport and consult with the City Planning Department. 

Mr. Shapiro presented his revised drawings of the carport.  Mr. Shapiro stated that he has reduced the overhang of the carport by one foot.  The roofline revision cuts the eave back to five feet off the property line.  The revised drawing also accurately locates the relationship of the posts to the house and property line.  Mr. Shapiro noted that the posts for the carport encroach one foot ten inches into the side yard setback and the eave projects no farther than the three feet allowed as a permitted encroachment. 

In response to the Board, Mr. Shapiro stated that he has no plans to enclose the carport.  He also noted that his neighbors had no objections to his carport.  The neighbor who was most impacted, rents their house and the house is now on the market to be sold.  Mr. Shapiro also added that his neighbors would sign a letter of support if needed.   

The Board discussed the revised drawings and the variance request.  Ms. Hall stated that the variance request is for one foot ten inches.  

There being no one else to speak for or against the variance application, the Chair declared the public hearing closed.

DECISIONS

Variance Application APP2006-00872, Matthew Shapiro

Mr. Schwartzman moved, seconded by Mr. Deitchman to approve Variance Application APP2006-00872, Matthew Shapiro with a two foot variance, part of which is six inches off the property line and subject to the conditions:  1) that the carport be constructed in substantial accordance with the submitted plans and with materials compatible with the existing dwelling; 2) the carport must remain open with no trellis or any other architectural features and the eave must be cut back one foot.  The motion passed unanimously.

MINUTES

Mr. Schwartzman moved, seconded by Mr. Deitchman to approve the minutes of Meeting No. 10-06 as amended.  The motion passed unanimously.

Mr. Deitchman moved, seconded by Mr. Schwartzman to approve the minutes of Meeting No. 2-07 as amended.  The motion passed unanimously.

NEW BUSINESS

Mr. Sternstein noted that he has a conflict with an application at the Board’s next meeting.  He said he would have Mr. Schwartzman fill in as Acting Chair for that application. 

The Board discussed upcoming applications and the Zoning Ordinance.

ADJOURN

There being no further business to come before the Board, the Chair adjourned the meeting at 10:00 a.m.
