This application seeks abandonment of a 69-square foot portion of the public right-of-way for Gaither Road in King Farm.
STAFF RECOMMENDATION:
Approval of the application, subject to the following condition:
BACKGROUND:
The applicant has requested abandonment of a small portion of the right-of-way for Gaither Road at its intersection with Redland Boulevard. The section is a two-foot wide section along the truncation in the northwest quadrant of the intersection. The approved Detailed Application for the retrofit of Gaither Road established that a ten-foot bikepath would be constructed along the west side of Gaither Road. Additional land dedication of two feet in width was necessary for the bikepath to fit within the public right-of-way for Gaither Road. Per the plat of dedication, the additional two feet was continued through the truncation at the intersection of Gaither Road and Redland Boulevard.
ANALYSIS:
Staff Comment:
Staff notes that there will be a paved overlook area of the "Gaither Pond" constructed at this quadrant of the intersection, and the abandonment will allow the features of that construction to be located outside of the right-of-way. The parcel containing the pond will ultimately be conveyed to the Mayor and Council after it no longer functions as a sediment control pond. Staff supports the request as all necessary public improvements at the intersection will be accommodated within the resulting public right-of-way. Staff has recommended conditions of approval that a plat of correction be submitted, and that the 5-foot public utilities easement, which parallels the right-of-way, be extended into the area to be abandoned.
