PROPERTY DESCRIPTION:
Size: 1.29 acres (56,449 square feet)
Zone: RPC (Rockville Pike Commercial)
Present Use: The subject property is located at the northeast corner of Rockville Pike and Halpine Road, approximately 140 feet west of the Twinbrook Metro Rail Station. The site is surrounded by a mixture of commercial and retail uses, to the north, south, and west. The property is currently developed, containing a 17,875 square foot strip retail center, comprising a home furnishing store, kitchen and bath center, and an automobile rental business. The property has a single street entrance on Rockville Pike and two entrances on Halpine Road. The property also shares inter-parcel access with the neighboring property to the north, via an existing ingress/egress easement located in the northeast corner of the site. The site also has access to the existing service drive located along the sites Rockville Pike street frontage, which allows vehicular access between the subject site and the neighboring properties to the north.
PREVIOUS RELATED ACTION:
· Use Permit Application U-286-83, Zion Avissar, a request for change-in-use of a portion of the furniture store located at 1616 Rockville Pike in the (the) C-2 Zone, approved by the Director of Planning on December 15, 1983.
· Use Permit Amendment USA83-286A, Zion Avissar, a request to allow the operation of an automobile rental business out of existing 1,500 square foot tenant space, in the RPC Zone, approved by the Chief of Planning on June 27, 1994. (EXPIRED DUE TO NON COMPLIANCE WITH APPROVAL CONDITIONS)
STAFF COMMENTS: The subject final record plat application is submitted in accordance with pending use permit amendment USA83-286B. As a condition of the pending use permit amendments approval, the applicant seeks approval to re-subdivide the subject property creating one record lot. The applicant is also seeking to purchase the existing private ingress/egress easement located in the northeast area of the site. This easement is currently owned by the City of Rockville and therefore the applicant must get formal approval to the purchase this property from the Mayor and City Council.
Under the applicants pending use permit amendment, the applicant does not propose to eliminate the inter-parcel access between the subject site and the neighboring property to the north. The applicants acquisition of the afore noted access easement, will allow the applicant to create added parking needed to accommodate all of the existing site business uses.
STAFF RECOMMENDATION: Approval is recommended subject to the following conditions:
1. Metes and bounds must be shown on all easements.
2. Applicant must request and receive formal approval from the Mayor and Council to acquire the private ingress/egress located in the northeast area of the property.
3. Bonds must be posted and permits obtained if necessary, from the Department of Public Works.
4. The final corrected record plat must be submitted in an appropriate electronic format as specified in Section 25-782(c) (d) and (e) of the Zoning Ordinance.
5. The plat must be revised to make modifications/revisions as identified on Planning Commission Exhibit A, on file in the Planning Division Office.
