PROPERTY DESCRIPTION:
Size: 15.186 acres (661,516 square feet)
Zone: I-3 (Industrial Park)
Present Use: The property subject to this request consists of two (2)
separately recorded parcels, Lot 11 - approximately 8.3 acres in size and
Lot 16 - approximately 6.8 acres. Once the parcels are consolidated the property
will total 15.2 acres (ref. PLT2000-00215). The subject property is located
on the south side of Research Boulevard approximately 1300 feet northwest
of the Md. Route 28 and Research Boulevard intersection. Lot 11 is currently
developed with a four-level (160,000 square foot) office building, with structured
and surface parking facilities comprising 627 spaces. Lot 11 and Lot 16 currently
share inter-parcel access, which allows vehicular site ingress-egress via
Research Boulevard and Md. Route 28. Lot 16 is improved with a four-level
(64,400 square foot) office building, along with structured and surface parking
facilities that total 240 parking spaces. The applicant is the owner of both
Lots 11 and 16, which are located in the industrial park subdivision known
as the National Capital Research Park.

Use
Permit U-95-78, Norman Tayler, a proposal to construct a 160,000 square
foot (two phased) office building on Lot 11 of the National Capital Research
Park in the I-3 Zone. Approved by the Director of Planning on August 16,
1978.

Variance
Application A-90-79, Plaza 270 Associates, a zoning variance of 8 feet from
the 50 foot setback requirement that on-site parking spaces are to maintain
from public street rights-of-way in the I-3 Zone. Approved by the Board
of Appeals on October 6, 1979.
- Variance Application
A-179-83, Plaza 270 Associates, a zoning variance of 50 feet from the 100
foot front yard setback requirement of the I-3 zone, to construct a one story
parking deck in the northern area of the subject property. Approved by the
Board of Appeals on September 10, 1983.
- Use Permit Amendment
U-95-78, Plaza 270 Associates, a proposal to construct an access ramp from
the parking deck of Lot 16, National Capital Research Park, to the west parking
lot on Lot 11. Also, reconfiguration of the west parking lot on Lot 11 to
insure number of parking spaces as approved under original Use Permit U-95-78
was maintained. Approved by the Chief of Planning on December 2, 1998.

Variance
Application APP99-0720, Plaza 270 Associates, a zoning variance of 100 feet
requested from the "aggregate" 200-foot side yard setback requirement
of the I-3 Zone, to construct a proposed parking structure in the north
side yard area of the subject property. Approved by the Board of Appeals
on January 15, 2000.

Permit USE2000-00606, Plaza 270 Associates, a proposal to construct an office
building addition and parking garage on the subject property located at
1600/1650 Research Boulevard in the I-3 Zone. (PENDING PLANNING COMMISSION

Record Plat PLT2000-00217, Norman Tayler, request to consolidate Lots 11
and 16 located in the National Capital Research Park industrial subdivision
into a single record lot. (PENDING PLANNING COMMISSION REVIEW AND ACTION)
STAFF
COMMENTS: The subject "ownership plat" is submitted in accordance
with pending use permit USE2000-0606. The applicant submits the application,
proposing to create two (2) ownership lots on Lot 17, i.e., Lots 17-A and 17-B.
The applicant seeks approval of the submitted ownership plat in an effort to
acquire financing of the planned development associated with pending use permit
USE2000-00606. Note, creation of the proposed ownership lots under this plat
is contingent on Planning Commission approval of the applicant's pending final
record plat (plat of consolidation) PLT2000-00217.
STAFF
RECOMMENDATION: Approval is recommended subject to the following conditions:
1. Any/all
references on the plat that state this a "plat of subdivision" are
to be removed and re-worded to reference "plat of ownership".
2. Reference
on the plat that "a SWM maintenance agreement is to be executed and recorded
among the Land Records Office of Montgomery County."
3. Bonds
must be posted and permits obtained if necessary, from the Department of Public
Works.
4. The
final corrected record plat must be submitted in an appropriate electronic format
as specified in Section 25-782(c) (d) and (e) of the Zoning Ordinance.
5. The
plat must be revised to make modifications/revisions as identified on Planning
Commission Exhibit "A", on file in the Planning Division Office.
