- RECOMMENDATION TO
THE MAYOR AND COUNCIL
A. Recommended APPROVAL (4-0) to the Mayor and Council of Text Amendment
Application TXT2000-0184, Hebrew
Home of Greater Washington, to amend Section 25-313(C)(1) allow ownership
plats to be used in residential zones when the property contains or is planned
for a use other than single-family residential.
- REVIEW AND ACTION
A. APPROVED (4-0) Final Record Plat PLT200-00225,
Whalen Family Trust - to record a single record lot of 42,151 square feet
on the east side of North Washington Street between East Middle Lane and Courthouse
Square.
B. APPROVED (4-0) Ownership Lot PLT2000-00226,
Macris Hendricks and Glascock, Inc. - to create two ownership lots on
the east side of North Washington Street between East Middle Lane and Courthouse
Square.
C. APPROVED (3-1 with Giammo against) Request for Waiver of the Underground
Installation of Electrical Transformer, Whalen Family Trust - to install
an above ground transformer at 11 North Washington Street.
D. APPROVED (4-0) request to amend the Preliminary Development Plan
and a Use Permit Amendment Application USA1996-0565A,
Pavilion Partners, Inc. - to allow a change of use as an amendment to
an approved Use Permit in the TCM-2 (Town Center Mixed-Use-2) Zone at 199
East Montgomery Avenue. Note: a follow-up discussion of the reallocation of
uses will occur at the August 2 meeting.
E. APPROVED (4-0) Use Permit Application USE2000-00611,
Capstone LLC Development Services - to allow construction of a 4,999 square
foot, free-standing restaurant in the RPC (Rockville Pike Commercial) Zone
at 775 Rockville Pike.
F. APPROVED (4-0) Comprehensive Planned Development Detailed Application,
CPD2000-0004A, Fallsgrove Associates
- Application by Fallsgrove Associates for Phase I infrastructure roads and
two stormwater management ponds near the intersection of Shady Grove Road
and Darnestown Road.
G. APPROVED (3-1 with Giammo against) Comprehensive Planned Development
Detailed Application, CPD2000-0001H,
Boston Properties LP - to construct a 185,000 square foot office building
on the east side of the future Preserve Parkway, south of Wootton Parkway.

BOARD OF APPEALS
A. DEFERRED, at the request of the applicant, Variance Application APP2000-00730,
Joseph Lynott for Fortune Oak, LLC -- A request for zoning variances fromlot
size, building setbacks, and parking setbacks on the subject property located
at Southwest corner of Tower Oaks Boulevard and Interstate 270 ramp J.
