I. RECOMMENDATION TO THE BOARD OF APPEALS
A. Recommended APPROVAL (5-0) of Variance Application APP2000-00730, Fortune Oaks, LLC - Zoning variances requested from lot size, building setbacks from abutting public streets, and distance on-site parking spaces must maintain from abutting public street rights-of-way, all as required in the I-3 zone. Variances requested in order to construct a three level office building on the property located at s/w corner of Tower Oaks Blvd. & the I-270 Interstate Ramp J.
B. Recommended APPROVAL (5-0) of Variance Application APP2000-00737, Fereidoun & Elizabeth Beiglarbeigi - Variances requested from side and rear yard setback requirements of the I-1 zone, in order to construct an auto service repair business facility on the property at 7424 Westmore Road.
C. Recommended APPROVAL (5-0) of Special Exception SPX2000-00289, Realty Capital Partners, LLC - A request to modify a previously approved special exception that allowed temporary and permanent relocation of the site's drive-thru customer banking facilities in the O-1 zone. Special exception requested in conjunction with the planned redevelopment of the subject property located at 611 Rockville Pike.
II. REVIEW AND ACTION
A. APPROVED (4-0-1 with Giammo abstaining) CPD2000-0004D, Jefferson at Fallsgrove Associates, LLC- Approval of 359 multi-family units and amenities for Fallsgrove Associates/JPI in the vicinity of Shady Grove Road and Darnestown Road.
B. DEFERRED (5-0) Request for Waiver of Underground Utilities Requirement, Fallsgrove Associates/JPI - Request for a waiver of the underground utility requirement for CPD2000-0004D, 359 multi-family units, relating to Verizon Communications phone pedestals.
C. APPROVED (4-0-1 with Giammo abstaining) CPD2000-0004B, TF Homes Associates, LP - Approval of 243 dwelling units, a community center/pool and Village Green park on a portion of the Fallsgrove site adjacent to Darnestown Road.D. APPROVED (5-0) Street Names, Fallsgrove Associates - Request for approval of street names for the Fallsgrove development.
