I.    REVIEW AND ACTION

A.    Final Record Plat PLT2009-00493, Montgomery County Public Schoolsfor the creation of a record lot of 8,9342 acres at 1800 Greenplace Terrace in the R-150 Zone. 

B.    Time Extension for Use Permit USE2006-00699, Duball Rockville LLCfor a one-year time extension of the Use Permit as amended, which allows construction of 485 multi-family units, 45,300 square feet of retail and a 175-room hotel in the TC-4 Zone at 196 and 195 East Montgomery Avenue. 

II.    RECOMMENDATION TO MAYOR AND COUNCIL

A.    Fee-in-Lieu of Public Use Space Requirement Policyto establish a fee to be paid in lieu of providing the required public use space in the new mixed-use zones, pursuant to Section 25.17.01d.2 of the new Zoning Ordinance.

III.    WORKSESSION

A.    Commission Meeting Procedures – to discuss changes to meeting procedures.

IV.  EXECUTIVE SESSION

Executive Session pursuant to Section 10-508 (a) (7) and Section 10-508 (a) (8) of the State Government Article, Annotated Code of Maryland, to obtain legal advice and to consult with staff regarding potential litigation involving an approved use permit.

Telephone calls and meetings with Commission members in advance of the meeting are not permitted. Written communications will be directed to appropriate staff members for response and included in briefing materials for all members of the Commission.
