I.    REVIEW AND ACTION

A.    Site Plan STP2009-00002, ZP No. 135 LLC – for an amendment to approved Use Permit USE2004-00681 in order to replace a proposed 3,420 square foot walk-in bank with a 3,000 square foot bank with drive-through in the MXCD Zone at 799 Rockville Pike. Approved by a vote of 5-1, with Commissioner Johnson voting against, and Commissioner Tyner absent.

II.   RECOMMENDATION TO MAYOR AND COUNCIL

A.    Street Closing and Abandonment SCA2006-00097, Montgomery County – for abandonment of a 36,914 square foot portion of unimproved right-of-way for Mt. Vernon Place, between Maryland Avenue and Monroe Street.  Voted 6-0 with Commissioner Tyner absent, to recommend denial of the application until the following occurs: 1. resolving the logic of the staff report in that the right-of-way is deemed unneeded but easements are recommended; 2. receiving updated utility company assessment of the need to locate in the right-of-way; 3. that the public benefit of the abandonment be elaborated and that a public information session be conducted by the City; and 4. that more certainty be determined for the private land not being encumbered by easements.  The Commission further recommended that a solution be considered to allow the parking lot encroachment into the right-of-way as an alternative, and that the Special Exception be allowed to continue to be processed, with the abandonment as a condition.

III.  WORKSESSION

A.    Comprehensive Master Plan (5.4 MB file)– for an update on work being carried out on the Comprehensive Master Plan (CMP), to discuss the initial findings from the review of the 2002 CMP and to discuss next steps.  Conducted worksession.
