I.    RECOMMENDATION TO MAYOR AND COUNCIL

A.    Text Amendment TXT2010-00224, Mayor and Council of Rockville – for an amendment to the Zoning Ordinance regarding requirements for public use space. Recommended that the provision to allow open area to count as public use space be limited to the MXE Zone, and that development expansions include cumulative additions, by separate votes of 6-0, with Commissioner Wiener absent.

II.    RECOMMENDATION TO BOARD OF APPEALS

A.    Special Exception SPX2010-00380 and Variance VAR2010-00006, C.C.B. School of Rockville – for an after-school tutoring service in an existing church in the PD-RS Zone at 800 Hurley Avenue.  Variance is from the requirement for minimum lot area based on maximum student attendance. Recommended approval of the Special Exception , and made a finding that it complies with the Master Plan, by a vote of 4-2, with Commissioners Hill and Tyner opposed and Commissioner Wiener absent.  Recommended denial of the Variance by a vote of 4-0-2 (Commissioners Medearis and Hill abstaining and Commissioner Wiener absent)

III.    REVIEW AND ACTION

A.    Site Plan STP2010-00013, ARE-5 Research Place, LLC – for a building addition of 5,220 square feet to an existing building in the MXE Zone at 5 Research Place. Approved 6-0, with Commissioner Wiener absent.

B.    Time Extension for Use Permit USE2005-00694, Rockville Volunteer Fire Department – for a one-year time extension of the Use Permit approval for renovation and expansion of the existing fire station at 380 Hungerford Drive. Approved 6-0, with Commissioner Wiener absent.
