Litigation Over Town Square Pavers to Continue
No Resolution on Mediation, Lawsuit to Move Forward
 
Rockville, Md., May 19, 2009 - Litigation related to the City of Rockville's complaint alleging that a breach of contract led to the failure of pavers in Town Square will continue, following failed mediation.

Macris, Hendricks and Glascock, P.A., contracted with the City to provide the full scope of civil engineering design services for the Town Center project, including the design of Maryland Avenue, Gibbs Street, and the Town Square plaza.  In June of 2008, the City filed a complaint against Macris in the Circuit Court for Montgomery County, Maryland.  The complaint stated that Macris breached its contract with the City and its duty of care to the City by committing acts of negligence, errors, and omissions in connection with the design of the roadways and plaza that ultimately led to the failure of the pavers in Town Center.   

As part of the litigation process, the City engaged in mediation with Macris, seeking to settle the case before trial.  Mediation took place on May 5, 2009.  No resolution was reached; as a result, the litigation will continue to move forward.  A pretrial hearing has been set for June 11, 2009.  The City has begun to prepare for trial.  No settlement negotiations are currently taking place.
